Description Post compensation follows the development of family care in Roman law, in ABGB in the new Civil Code, in which we can follow the same elements. Adoption represents a type of substitutive family care guaranteed by the state and governed by the law, in which the child is accepted as the parents‘own child.The objective of the paper is to point out the first mentions of the above matter and analyse the Roman legal view of adoption. The conclusion will focus on the new Civil Code, which will bring to the adoption of change.
