Description This paper analyses the relation between Falcidian Portion (quarta Falcidia) and BGB (German Civil Code). Grounds for omitting the rule of Falcidian Portion are briefly explained, however, the main attention is paid to examinations of consequences caused by the absence of Falcidian Portion within BGB. Comparison with Roman law shows that Falcidian Portion would fit the system of BGB and would provide protection of heirs that would be suitable especially in case of unpretermitted heirs.
