Description The purpose of this brief paper is to present the understanding of the relationship between freedom of speech and enforcement of copyright online in the current case law of the European Court of Human Rights. The means to achieve this is a critical analysis of two recent judgments (Ashby Donald and Others v France, "The Pirate Bay" v Sweden), which substantively dealt with this issue for the first time. Finally, the potential impact on the decision-making practice in the Czech Republic is presented (specifically to the case of the so-called "Liberec pirate").
