Description The aim of this article is to develop certain ideas mentioned in the presentation of JUDr. Jan Horecký, Ph.D. concerning the topic “Occupational safety and health – inner core of the labour law” presented during international science conference “Labour law 2018” in Třešť. The author in this article presents his thoughts on proper status and place of labour law in legal system of the Czech Republic. The author focuses mainly on workplace health & safety in relation to the criminal law, precisely to the criminal liability. Nowadays, an effective criminal code contains several descriptions of criminal acts including those special provisions concerning employer´s liability for violating the rules on workplace health & safety. The author will answer the question whether the protection in relation to the workplace health & safety provided by the currently effective penal code is sufficient. Furthermore, the author devotes his attention on “de lege ferenda” possibilities whether other violations of the workplace health & safety rules should establish criminal liability for the employer.
