| Description | The chapter in the monograph deals with the protection of cultural monuments in the construction of roads. Both the Act on State Preservation of Monuments and the relevant provisions of the Building Act are analyzed. Based on this analysis, the tools for the protection of cultural heritage areas and the protection of cultural monuments themselves are gradually characterized. The unique situation of restoration of the monument due to the construction or modernization of transport infrastructure is mentioned as well. The key finding of this chapter is that the state monument care authorities have strong powers, particularly due to the institute of binding opinions, to protect cultural monuments in the construction of transport infrastructure and can also protect culturally valuable objects during construction activities. |
