Description This paper deals with legal aspects of using metal detectors to search for archaeological finds. Archaeological finds are being unearthed mostly during archaeological excavations, but it is not possible to avoid artefacts being found other ways. These finds can be found accidentally or by a person who is not allowed to carry out archaeological excavations. To be able to judge the nature of archaeological finds, it is necessary to know its legal and scientific definitions. First part of the paper analyses the Czech and Slovak legal regulations. The special attention is paid to the Monument Act of both countries. The second part mainly focuses on activities of administrative bodies. Selected foreign studies and approaches to this issue are given as an example. The last part discusses the possible trends and directions of the Czech legislation in the future.
