Description The article in question deals with the question of whether a certain degree of psychopathic traits (not reaching the level of mental disorder according to § 123 of the Code of Criminal Procedure) can have an influence on the assessment of the sanity of a juvenile. There are still disagreements about whether the relative criminal responsibility of juveniles enshrined in § 5 ZSM is a special case of insanity or not. Therefore, the above-mentioned question is solved first by connecting to the issue of the interaction of psychopathy and conditional insanity of juveniles.
