| Description | The paper deals with the institute of an action against a decision of an administrative authority in the context of liability for damage caused by the state in the exercise of public authority according to the Constitution and Act No. 82/1998 Coll. It discusses the basic features of an action against a decision and its significance, as well as the purpose of state liability for damage. The paper focuses on the relationship between the institutes and their mutual interaction and reflects on the doctrinal background and current case-law conclusions of the highest courts related to the chosen topic and presents possible changes to the de lege ferenda legislation. |
