Description Prisoners applying for conditional release have to fulfil several basic conditions. One of them is to serve the appropriate part of their prison sentence. Sometimes prisoners meet this condition by their previous detention in custody. From a Czech law perspective, the length of time in custody is usually counted as a part of the prison sentence. Hence, these convicted persons can submit an application for conditional release before they being placed in prison to serve their punishment. Due to the wording of the Czech Criminal Code, a problem may arise for these convicts. The article explains whether this practice is in accordance with the Czech law.
