Description The article focuses on the ne bis in idem principle (or the principle of prohibition of double jeopardy) and the related issue of double jeopardy in environmental protection. The aim of the article is to establish how the European Court of Human Rights interprets the ne bis in idem principle and to outline the shift that has occurred in the case law of the European Court of Human Rights in its approach to this principle. At the same time, the aim is to identify how this principle is interpreted in the case law of the Supreme Administrative Court, with a focus on the case law concerning administrative punishment in the field of environmental law. The case-law in question reflects situations in which, on the basis of an action against a decision of an administrative authority, the offender claims that he has been punished twice for one act, which should violate the principle of prohibition of double jeopardy.
