Description This study in detail analyses content and controversial points of the rulings of constitutional courts in Poland and Germany concerning constitutionality of the transposition of the frame decision on the European Arrest Warrant. Author points out that the Polish solution is unlike the German one and he draws a conclusion for the possible future decision of the Czech Constitutional Court in the same question. He refers to the fact that there were different reasons for the proceeding before the constitutional court and the constitutional bases as well in those states.
