Description | In most European countries the unfair competion law became a kind of "case law". A good number of "case groups", that has been regarded as dishonest, were now held to be basically permissible. The reasonably well-informed, observant and circumspect average consumer was better served by providing more information than by prohibitions.. The judge-made law need not only more economic approach, but also the following consideration: Human competittive behaviour is very strongly biologically determined. In order to secure the transmission of our genes to the next generation, nature has provided us with competitive tools and competitive behaviour, in particular a certain amount of aggression and the ability of advertising behaviour. The cultural development of humanity is hugely accelerated by man's imitative behaviour. |
