Description	The article deals with constitutional status and competency of prosecution in Austria. The Author focuses on the hierarchical relations inside the prosecution system and she points out differences in comparison to the Czech legal framework. She mentiones relevant legal regulations, in particular the revision of the Law of Criminal Procedure, implemented by Code no. 19/2004 BGBl. that represents a radical change in Austrian criminal procedure, especially in the preliminary procedure stage. In the end the author introduces a personal issue of the Austrian Prosecution System.
