| Description | The article deals with the proposal to law on mediation in non criminal matters of the Ministry of Justice of Czech Republic submitted in October 2008 from the point of view of legal theory and conformity with the constitutional order and european law. It deals with the co-operation between the civil proceedings and mediation, taking into account the exluding of limitation and prescription of law in the cases of alternative dispute resolutin to family law conflicts. It considers also the possibility of execution of mediation agreements through the public power. |
