Description This text analysis the process position of the charged, accused in the criminal process, from the Lisabon reform treaty 2008 and Bill of basic rights of the European Union 2007 point of view. It does comparison this state with national legislation in the Czech Republic. Conclusion: standard of the european law does not go over the standard of the national criminal process and constitutional law of the Czech Republic. On the contrary, this national standard is in the some directions higher; f. e. the reach of the principle ne bis in idem.
