Description The relations within the European Community are conceived as typical legal relations between two (ore more) subjects with different domiciles. Their main aim is to realize their commercial or other legal (and financial) interests, so they really need the legal protection. This protection is vested within the regulations of civil procedure law. European Community adopted regulation No. 1896/2006 of the European Parliament and of the Council of 12th December 2006 creating a European order for payment procedure that came into force on 12th December 2008. The purpose of this Regulation is to simplify, speed up and reduce the costs of litigation in cross-border cases concerning uncontested pecuniary claims by creating a European order for payment procedure. This article deals with the basic questions of summary proceedings and it also describes its incidence on interpretation of European order for payment procedure.
