Description The focus of this paper is to analyze the impact of the European law on the arbitration proceedings. In the concrete, it deals with the arbitration exception in article 1 par. 2 lit. d) of the Regulation Brussels I. Firstly, the relations between state courts and arbitration courts are described. Then, the ECJs judgments concerning the possibility of arbitration courts to refer a preliminary question to ECJ are presented. Afterwards, the current arbitration exception in the Regulation Brussels I is introduced. Subsequently, the judgments of the ECJ relevant for the application of the Regulation Brussels I on arbitration proceedings (namely on proceedings concerning validity of the arbitration agreement, anti-suit injunctions and ancillary and control functions of state courts) are analyzed. Finally, the spheres of application and non-application of the Regulation Brussels I on the arbitration proceedings are summarized.
