Description This text analysis a question connectioned with subjective side of crime (mens rea): the conciliation like form of the will-element of the alternative mens rea in the sense of the section 15 paragraph 2 Criminal Code. On the basic of approaches of austrian theory (Abfindungstheorie, Billigungstheorie) and czech legislation and theory are examine the genesis, legal nature and aspects of the interpretation of the concept of conciliation under the new czech criminal-law legislation. Conclusion: the conciliation like form of the will-element of the alternative mens rea, as opposed to awareness, founds the right disinterest in the sense of criminal law; this right disinteres is different concept from real disinteres, as the case may be full disinteres.
