| Description | The paper deals with the question of discharging of an arbitration clause in a situation of withdrawal from a prior contract in the civil relations. The independent judging of prior contract and arbitration agreement does not make any substantial problems in the cases of invalidity of a prior contract neither in the commercial or civil legal relationships. The paper deals with the issue whether the arbitration clause is discharged upon the withdrawal from the prior contract under the Czech Civil Code. |
