Description | By a sales contract a seller is obliged to deliver separately specified or quantitatively and by kind specified movable asset (goods) to a buyer and make over the property right to this asset and the buyer on the other hand is obliged to pay sales price according to fundamental provision § 409 of the Commercial Code (§ 409 is hereat the only fundamental provision). The sales price has to be agreed in the contract or there has to be set the way of its supplementary evaluation, unless it is clear from the process of contract negotiation that parties are willing to contract even without determination of the sales price. In this case the buyer is obliged to pay sales price set according to § 448 of the Commercial Code. |
