Description	The author deals with th problem of relation between Labour Code and Civil Code, she examines the legal possibility of this realtion and she inclines to the subsidiary aplication of the Civil Code. Then the author deals with the institute of withdrawal from the contract in the labour law, especially from the contract of employment.
